How probate works in Monterey County

The short answer: Probate is filed and heard at the Monterey Courthouse, 1200 Aguajito Road, Monterey, CA 93940, at (831) 647-5800. Probate court is Wednesdays in Department 13 on the third floor. Attorneys must e-file; self-represented filers may e-file or use paper methods. The clerk assigns the hearing date when accepting the petition—future dates cannot be pre-booked.

Monterey publishes Probate Notes and a probate calendar online. Remote attendance generally requires RA-010 and prior court authorization.

Represented parties use an approved EFSP. A self-represented petitioner without electronic access may mail, use the courthouse drop box, or file in person. Do not put loose papers or cash in a drop box.

The original will cannot be reduced to an electronic scan for lodging purposes. Probate Code section 8200 generally requires its custodian to deliver it within 30 days after learning of death. Bring or mail the intact original as the Probate Clerk directs and reference the electronic case number.
