Filing and the original will

Yuba's Local Rule 9 mandates e-filing in probate for represented parties. A lawyer may seek a hardship exemption with EFS-007 and proposed order EFS-008. Self-represented parties may use paper.

The court's current public e-filing materials do not clearly list the original will among electronically accepted documents. Probate Code section 8200 requires delivery of the tangible original; deliver it to the Civil Division and confirm the clerk's preferred linking notice rather than uploading only a scan.

Probate notes, orders, and hearing setting

Probate notes reflect staff's evaluation and are not tentatives. If the note recommends granting a petition, no appearance is required and the matter is submitted on the papers. If the case is absent from the notes, appear.

Local Rule 4 requires the proposed order at the time the petition is filed and says the hearing date must appear on the order. The clerk supplies the initial date; later proofs of service, publication, subscribing witness, and other hearing-related filings must also bear that date.

Remote appearance, local forms, and fees

For a civil/probate Zoom appearance, file the required Judicial Council remote-appearance forms and follow the court's instructions. The existence of a Zoom option does not override a note requiring attendance or a judge's in-person order.

Yuba local probate forms PR03003 and PR24017 address investigator appointment and prima facie determinations, not the ordinary opening of a decedent estate. No county-specific opening surcharge was identified.
